By using FlipStack ("the App"), you agree to these terms. If you don't agree, please don't use the App.

1. What FlipStack does

FlipStack is a pricing and listing assistant. You take a photo of an item, and the App uses AI to identify it, estimate its market value, and generate a listing draft you can copy and paste to any marketplace. The App does not buy, sell, ship, or escrow anything, and does not post directly to any marketplace — you remain responsible for any transactions you make based on its suggestions.

2. Pricing suggestions are estimates, not guarantees

The price suggestions shown in the App are estimates derived from AI models and, where available, public marketplace data. Actual sale prices vary widely based on condition, demand, location, and timing. FlipStack does not guarantee that any item can be sold at the suggested price, or sold at all. Use the suggestions as one input among several when making purchase or pricing decisions.

3. Subscriptions

• The App offers a free tier with a limited number of scans per period, plus paid tiers ("Plus" and "Pro") that unlock additional scans and features.
• Subscriptions are billed monthly through your platform of purchase: the Apple App Store (iOS) or via our web checkout powered by RevenueCat and Stripe.
• Subscriptions auto-renew by default. You can cancel at any time through the platform you bought from. Cancellation takes effect at the end of the current billing period.
• Refunds are handled by the platform you bought from, in accordance with their respective refund policies.

4. Acceptable use

You agree not to:

• Reverse-engineer, scrape, or attempt to extract source code or model weights through the App or its API.
• Use the App or its API in ways that violate the terms of service of OpenAI, eBay, RevenueCat, Stripe, or any other third-party service the App relies on.
• Submit photos that contain illegal content, intimate images of others, or images you do not have the right to share.
• Attempt to interfere with the App's operation, exceed rate limits, or use it to harm other users.

5. Account, data, and privacy

Your privacy is covered by our Privacy Policy. By using the App you also agree to that policy.

6. Disclaimer of warranties

The App is provided "as is", without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that the AI's suggestions will be accurate.

7. Limitation of liability

To the maximum extent permitted by law, FlipStack and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App — including but not limited to lost profits, lost savings, or business interruption — even if we've been advised of the possibility of such damages. Our total aggregate liability for any direct damages will not exceed the amount you paid us in the 12 months preceding the claim.

8. Changes to the App and these terms

We may add, change, or remove features over time. We may also update these terms; if changes are material, we'll update the "Last updated" date and, where appropriate, notify you in-app. Continued use after a change means you accept the updated terms.

9. Termination

You can stop using the App at any time. We can suspend or terminate accounts that violate these terms or that we reasonably believe to be engaged in fraud or abuse.

10. Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in San Diego County, California.
